Serious claims against officials

A hostile and divisive environment within the Goldens Bridge Fire Department, coupled with claims of inappropriate behavior, an improper election and illegal spending of taxpayer money, has led to the exodus of a number of longtime members. Through interviews with a number of members and former members, The Ledger has learned that the atmosphere within the volunteer department had become so charged in recent years that some long-serving and high-ranking department members were concerned for their safety.

In all, this led to one member hiring a lawyer to combat harassment at the firehouse last year, a challenge in Westchester County court about the validity of a 2010 election, and a complaint filed to the state comptroller's office about false claims regarding retirement eligibility.

All five members or former members of the
department The Ledger talked to said there were questionable financial practices within the department.

There was "no accountability," said Steven Nardozzi of the
department when he served as its president from 2004 to 2007. He said at that time he warned department members to be more accountable of how departmental financial resources were being spent because of the possibility of being audited by an outside governmental agency.

"It falls on deaf ears," said Mr. Nardozzi. "They think, small town, who's going to care? Somebody's going to care, I think."

"There's so much money going out the door there you wouldn't believe it," said John Gagliardi, a former
Goldens Bridge fire chief who has not been active with the department in a number of years after being "pushed out" after 44 years of service. "The whole department is a disgrace.

The other
departments don't even like to call them."

Ed Brancati Sr.,
Goldens Bridge Board of Fire Commissioners chairman, said the Goldens Bridge fire district, which is funded by taxpayers, undergoes regular audits by independent outside auditors and did so for years before it became a legal requirement for all fire districts.

However, the
department itself does not receive tax money, instead relying on money from fund-raisers and a portion of the fire protection insurance fees homeowners pay annually.

Fire Chief Albert Melillo did not return messages left by The Ledger seeking comment.

False retirement claims?

Although the members mentioned different areas where they suspected shady financial practices, four of them said that one
fire official was misusing taxpayer money by granting at least one member credit for meeting annual standards of eligibility for a retirement package when he had apparently failed to do so.

Firefighters must meet certain criteria - attend meetings, respond to
fire calls, participate in drills, etc. - to obtain enough "points" each year to be eligible for a year of credit towards Length of Service Awards Program (LOSAP), a taxpayer-funded retirement package for firefighters. They all said that at least one member repeatedly failed to participate in department activities but was awarded the necessary points anyway by a department official. The department heads ultimately tally the information and then pass it onto the Board of Fire Commissioners, which submits it.

One current member who requested anonymity told The Ledger he made an anonymous complaint about this to the state comptroller's office a few months ago.

Mr. Brancati said the comptroller's office has not contacted the district about the complaint and no one from the
department has raised the allegation with the district.

"Nothing's been formally said to us about that," Mr. Brancati said. "The Board of
Fire Commissioners would look into any specific allegations but nothing's been said to us about that." He also questioned how someone else would know whether or not a firefighter received credit for a year of eligibility in LOSAP.

A former firefighter, who asked to remain anonymous, said there are a few "power hungry"
fire officials causing the problems.

"It's terrible," he said. "They do what they want when they want without membership approval, and that's wrong. I'm sure money was spent without membership approval."

In general, criticism of the management of the
department - both the commission board and department leadership - was a theme firefighters repeatedly mentioned.

They said a number of
fire officials are contentious, causing a rift in the department. All five people The Ledger talked to either left the department entirely or are no longer active members, mainly because of the divisive atmosphere.

"I no longer participate in response activities because of the management of the
fire department," said Mr. Nardozzi. "There are lots of people that just don't go anymore."

Improper election?

There is an Article 78 complaint filed by former
department member Richard Barrett against the department, with affidavits from other members, in Westchester County court, challenging the outcome of a special election the district held in 2010 to elect one of its assistant fire chiefs. No ruling has been made yet.

The suit seeks that the original election outcome, determined by a majority vote but which the Board of Commissioners failed to ratify, be upheld. It calls into question the second "special" election, in which a different member was elected assistant chief. Among the claims, the suit and affidavits assert that proper notice was not given about the second election.

In an affidavit submitted by Mr. Nardozzi that accompanies the complaint, he states that the "Board of
Fire Commissioners continually ignores the laws of NY State and fails to give proper public notice of their meetings.

In addition, the Board of
Fire Commissioners would go into 'executive session' to discuss issues they desired to keep from the membership of the Goldens Bridge Fire Department. Despite my complaints regarding this action, I was ignored."

Mr. Brancati would not comment on the matter because it is pending litigation.

Harassment Former
Goldens Bridge Fire Captain Brian Lynch told The Ledger he had to leave the department recently because he was being harassed by members of the district for months. According to a police report in May 2010, Mr. Lynch and then Fire Chief Walter Hughes both said Mr. Lynch was the subject of repeated harassment with the latest incident being a note taped to his locker that said "YOU'RE NEXT BITCH" with a picture of a crying face below it.

Police told him to continue to report these incidents but that they could not press charges because no criminal act had been committed. Mr.
Lynch also said his car was vandalized and someone turned on his equipment battery so that it would not function correctly.

Mr.
Lynch hired a lawyer and made a formal complaint against the department about the harassment but no charges or discipline were brought against any member of the department. In a taped conversation between Mr. Brancati and Mr. Lynch, Mr. Brancati at first said the fire chiefs had looked into the matter but then said it was a police investigation.

In either case, he repeatedly refused Mr.
Lynch's requests to provide him with a copy of any documentation regarding the investigation.

"Nothing was done about it, to correct the situation - no investigation, no internal investigation," a former
fire member that requested anonymity told The Ledger. "The Board of FireCommissioners looked the other way and didn't do anything about it

It was really shocking when his vehicle was vandalized.

Nothing was done about it.

Nothing They're protecting each other."

But Mr. Brancati told The Ledger that he did not give Mr.
Lynch any documentation because he had a lawyer with him, and that the district did conduct an investigation but "we had no ability to determine who may have messed with his equipment."

However, he said because of those incidents the district has installed a security system in the firehouse. Also, the Board of Commissioners mandated that
department members attend courses on violence in the workplace and harassment.

They also offered leadership training classes.

"We took a number of corrective actions," said Mr. Brancati. "I think the actions we took speak to the fact that we took his complaint very seriously."

Despite that, after 10 years with the
department, Mr. Lynch said that while he wanted to stay, he ultimately decided to leave because he feared for his safety.

Mr. Nardozzi agreed, stating that the
department had become too dangerous to work at. Because of that, Mr. Nardozzi said he has not been active in the department in the last five years, despite having reached the status of lifetime member due to his more than 25 years of experience.

"It's nothing I need," Mr. Nardozzi told The Ledger.

"What
Brian had to go through, this is so dangerous in a fire department setting that it's not worth volunteering and suffering personal loss I don't need to volunteer my expertise if I'm going to get hurt doing it."

But the alleged harassment of Mr.
Lynch was only one of the problems he described within the department. Mr. Lynch has written a blog, gbfdx2144.blogspot.com, that details a number of questionable acts by management of the department and the district, and some of the firefighters.

The blog's claims were confirmed by some of the firefighters The Ledger interviewed.

The blog states that a
fire lieutenant in 2009 was insubordinate to Mr. Lynch's commands as captain and was ultimately suspended "for disobeying a direct order from me on a mutual aid brush fire and then falsifying his story to our chief stating he had followed orders from a Croton Falls officer. When reached for verification, the Croton Falls officer confirmed the story was falsified."

In early 2010, the
fire chief at the time was suspended due to his actions at the Deer Park Tavern fire in Katonah in January of that year, according to documents The Ledger obtained from the fire district.

The blog also addresses that suspension, although it questions the motives behind the suspension and whether the chief should have been suspended at all.

Mr.
Lynch also said that after a drill in South Salem, department members "drag raced" two of the fire trucks down Route 138, occupying both the eastbound and westbound lanes, as they headed west.

FOIL stonewall?

The Ledger itself had a difficult time acquiring public information from the
department and district. A Freedom of Information Law (FOIL) request to the department seeking any documentation related to the harassment of a member was not responded to for nearly three months - three times longer than allowable under the law.

The
fire district ultimately responded but refused to answer a portion of the request because it involved the fire department. When asked for that information, the fire departmentresponded that it is a private organization and not subject to FOIL, and therefore suggested The Ledger make the request of the fire district again. The Ledger finally received a portion of the documentation six months after initially requesting it. FOIL requires the information be made available within 20 business days.

It’s time to clear the air — and the atmosphere — at the Goldens Bridge Fire Department.

A number of members and former members of the volunteer department told The Ledger this week that the department is rife with problems and questionable behavior and activities. They spoke of misuse of money, an improper election, and harassment, among many other concerns.

Perhaps most alarming, though, is how they described the atmosphere of the department: divisive and hostile.

This is not how any department should be run, particularly one with a 102-year history of admirably serving the residents of Goldens Bridge. The department is a pillar of the community and a connection to its past — for decades, it responded to emergency calls in the old Goldens Bridge center, long since destroyed to make room for Interstate 684. Its impressive-looking firehouse is one of the most recognizable landmarks in Goldens Bridge, standing tall on Route 138 and that residents regularly view with pride. Yet what’s apparently happening inside that firehouse is casting a dark shadow over the hamlet.

Are such accusations to be expected from a few disgruntled members, none of which are still active with the department, and therefore have no validity? Perhaps that could be the case if there were merely a few complaints from a couple of them. However, there were a number of firefighters who lodged claims of problems within the department — their stories were consistent and come from long-serving members who were all high-ranking fire officials at one time. These are not just rogue members bitter about their departure.

Also, The Ledger has been hearing similar rumors for months from a number of outside sources, which actually prompted its investigation. And keep in mind the stonewalling the fire district did to delay releasing public information The Ledger requested through the Freedom of Information Law (FOIL). It took six months for The Ledger to receive a document that by state law the district had to turn over within 20 business days. Unfortunately, this is an established pattern of behavior.

Power struggles and cronyism inevitably occur on some level in most organizations, even volunteer fire departments, but cannot be accepted if they compromise safety. How can a firefighter trust his life to his fellow firefighters when entering a burning building if those same members are harassing him or one of his colleagues? Accidents — dangerous ones — occur when trust is broken among firefighters.

So what has to be done?

The Board of Fire Commissioners needs to hire an outside auditor to conduct an exhaustive review of the finances of the department for the past five years, in addition to the regular audit of district finances. It also must hire a consulting firm to perform a management and performance audit of the department and the district — including the commissioners — reviewing the methods and policies in place, suggesting organizational and employee improvement, and establishing standards for future employee performance. Once completed, all reports must be made available for public consumption — personal employee information may be redacted.

This will offer fire officials an inclusive look through the department and district in order to best gauge what steps are needed to move forward as the department continues to provide its exemplary emergency service, but without the whispers of impropriety.

Guest Column: Many fear revenge by fire officials

I would like to sincerely thank Ledger Editor Ken Mastro for his article regarding the Goldens Bridge Fire Department and district. I wish to state that there are many fine members who are still within the department serving the community as part of this extremely valuable service. The story which resulted in the article should not reflect the department as a whole.

The story accurately captured many of the events of the past 18 months including how the Board of Commissioners refused to take action. My personal situation at the department became unbearable because the Board of Commissioners would not step in to assist; I was even treated in a combative fashion by them.

Those of you in our town who know me understand my commitment to the community. I wish more than anything that I could return as an active firefighter. Others who have chosen to walk away wish the same. Our numbers are not just the individuals interviewed for the article but in fact are almost proportional to the number of truly active members remaining. My safety was jeopardized due to gear tampering/theft; it was impossible for me to remain a responder.

In his report to the Board of Commissioners and to my attorney, former Fire Chief Walter Hughes estimated that five to eight individuals were working together to harass me. Those individuals are the leadership now of the district and department. As demonstrated by the non-compliance to the Freedom of Information Law request by this paper, stalling and hoping things go away is the tact of this group.

One of the most disturbing things to come out of all this is the fear of retribution by not only me, but by many others who are afraid to speak up. The editor of this newspaper will agree that fear is rampant. Is that the kind of role we want these individuals to have (many of whom are not even residents of the Goldens Bridge Fire District)?

Summary of my time at GBFD Fall 2009 - December 2010


I would have been elected as a Chief of the Golden's Bridge NY Fire Department. Instead I was driven out along with Chief John Barrett and Chief Rich Barrett by some small minded, selfish towns folk with an agenda. My car was vandalized, my fire gear was stolen, my fire gear was tampered with for 6 months and culminated with an overt threat. Legal boundaries were crossed. Our local fire district ignored my pleas for help. Instead it was easier to walk away from something I loved instead of dealing with an agenda filled negative environment.

We had struggled with one officer who was consistently insubordinate to me in my role as Captain of the Fire Department. We suspended him once for disobeying a direct order from me on a mutual aid brush fire and then falsifying his story to our chief stating he had followed orders from a Croton Falls Officer. When reached for verification, the Croton Falls officer confirmed the story was falsified. The four top officers spent many hours attempting to find an approach to have this individual show some sort of respect and alliance to our chain of command in the fire dept.

It was very difficult for me to relate to this officer's personal values. He stated directly to me at the wake of Bob Dalzell who had dedicated so much of his life to preservation of firefighting history at the Firefighters museum in Hudson NY: "you don't realize how much I don't give a fuck". Another senior member on another occasion at a department picnic attacked him because he was bragging about sexual conquests and bragging about photos of such and we all knew the girl he spoke of. His set of morales does not relate to most socially acceptable norms.

The real trouble seems to have begun 9/15/09. We held a car fire drill at the South Salem Firehouse. Upon returning to our firehouse, two members came up to me bragging how two ex-chiefs lined up Tanker 1 and Engine 140 side by side full of firefighters and 'drag raced' heading West on Route 138.

Chief Hughes did not want to single out the problematic officer for another repeated string of issues including playing soccer with the plastic Jesus from the Fire Dept's nativity set. He called in a number of newer members of the department and listed off a long string of issues that were occurring at the fire house including breach of the Chief's car and desk, broken items around the fire house with no accountability, my gear and car being tampered with, two other members gear being tampered with... Witnesses stated the problematic officer was responsible for severals of the incidents.

The following week, President Al Melillo was in our Chief's office screaming at the top of his lungs in rage at Chief Walter Hughes: "I am going to fucking run someone against you and force you out of office" as I was walking past the office. He yells at me to come into the office: "And you, you fuck, you are not to fucking drive the fucking chief's car". He demands the keys to the car and I oblige. I skip that evening's drill and have Chief Hughes drive me home. Chief Hughes informs me that President Melillo told Chief Hughes to "just let things go" in regards to the behavior of the members and that Chief Hughes had "No Right" to address the members as a group. Chief Hughes replied "Like I should let the drag racing go?" to which President Melillo exploded in rage. Later on I observed that neither of the ex-chief's had signed the drill sheet from 9/15/09 even though multiple people stated the contrary.

The next single event and most damaging was the election of the newest commissioner to the Golden's Bridge Fire District. Immediately after his election he deliberately stood up in front of the entire department and attempted to embarrass Chief Rich Barrett. I stated in defense of Chief Barrett: "Holy Shit". I could not believe that the gall this man had to pull this stunt. His clear intent was to embarrass Chief Barrett in front of the Department. This was the first week in January 2010.

Next came the evening that changed GBFD for the worse. January 26, 2010 we were the second due department at the Deer Park Tavern Structure Fire. Our working crews were split into two groups by me as the senior officer on site for our department. I put NIck Turi and Alex Roth at the front door while I worked in the back of the structure with Chris Weigert, Shane Collins and the Katonah FD. We had been working several hours and Alex Roth came up to everyone working in the back of the structure and announced "Johnny was wasted and got thrown off of the fire scene". By the time I was done working the scene at approximately 9AM, Commissionner Robert Melillo had already notified Chairman of the Board of Commissioners Ed Brancati and they instructed Walter Hughes to suspend Chief John Barrett. The below law was broken:

TOWN LAW, section 176.11
...Such rules and regulations SHALL NOT AUTHORIZE any member of the Board of fire commissioners to interfere with the duties of the chief or assistant chief at such times as the department or any company or squad thereof is on duty.

Follow on interviews conducted by Chief Walter Hughes revealed that Commissioner Melillo left his post of pump operator and was negligent of his duties per South Salem Chief Joe Posadas who was acting as the water supply Chief. Commissioner Melillo's actions jeopardized the working crews on the fire scene. When I left the fire scene at apporximately 9AM, George Tockstein was brought to the scene by Commissioner Melillo to either act as Senior officer on scene or as pump operator for water supply. Ex-Chief Mike Cassar interviewed George Tockstein and Commissioner Melillo and inquired who the Senior Officer was on scene, to which George Tockstein pointed to Commissioner Melillo.

From Ex-Chief Cassar:

"I was looking at some pictures I had taken at the Deer Park Tavern fire and stumbled upon a picture of Robert Melillo away from his post as a driver. This is where he ended up bringing John Barrett and Walter Hughes up on charges. My question is, why didn't Robert get brought up on charges for leaving his post?"





Further interviews revealed that Commissioner Melillo per Batallion Chief John Jackson and Katonah Chief Paul Bauer was "obviously out to get" Chief Barrett.

Another interviewed conducted by Chief Walter Hughes and witnessed by me of Battalion Chief Gary Weber revealed that Chief Weber interviewed Chief Barrett on scene and indicated that he did not appear to be drunk or 'wasted' as testified by Alex Roth. Chief Weber indicated that Chief Barrett appeared to be in a 'deep sleep'. Chief Weber is also a law enforcement officer and is very capable of determining drunken behavior. Chief John Barrett had in fact responded to the fire call while on prescription Ambien. His condition was compounded by Vicks Formula 44 for a cold. Chief Barrett was a first responder for FDNY on 9/11 and was on prescription Ambien to assist his sleeplessness.

Commissioner Melillo also contacted firefighter Shane Collins in an attempt to "get" me following this evening. Shane advised me that Commissioner Melillo was asking if he could include me in any knowledge of John Barrett's condition on the evening of Jan. 26, 2010. Since I was working in the rear of the structure, I did not encounter Chief Barrett while he was on the fire scene. As demonstrated by my letter on this website from the beginning of Feb. 2010, John Barrett was immediately suspended by the district without ever being interviewed. Nor was I ever interviewed as the Senior officer on the fire scene. Selective witnesses Alex Roth and Nick Turi testified that Chief Barrett was wasted.

The Golden's Bridge Fire District then realized they had over stepped their authority by suspending John Barrett. They instructed Chief Walter Hughes to state that he suspended Chief Barrett. In fact, Chief Hughes had not even conducting any investigation. Chief Barrett was then given a 4 month suspension (to ensure he would be suspended for the May 2010 elections). Chief Hughes was questioned whether he allowed Chief Barrett to drive home from the fire scene. (It should be noted that Chief Hughes was on scene as the acting Paramedic for Westchester EMS, not as GBFD Chief). He responded he had driven Chief Barrett home. He letter went back to the district and informed them that he had misstated that he drive Chief Barrett home.

Walter Hughes was given a 45 day suspension for his statement. The Fire district asked him to not share that he was being suspended as they knew this would be viewed negatively.

So GBFD headed into the 2010 Election cycle. George Tockstein ran against Walter Hughes for Chief. This was a clear insult to Chief Hughes put together by several members banding against him. Randy Sant was lied to in that he was told Chief Rich Barrett was not interested in running for 2nd Asst. Chief. Randy withdrew from the election when he learned in fact he was lied to.

Al Melillo was nominated by the Nominating Committee lead Commissioner Robert Melillo to run for 1st Asst. Chief. Chief John Barrett decided he had enough of the gamemanship of these people and decided he would not seek any position in the department.

Chief Hughes defeated George Tockstein in the election, Rich Barrett was elected 2nd Asst. Chief. Commissioners Robert Melillo and Joe Simoncini both refused to ratify Chief Richard Barrett as 2nd Asst. Chief. They officially would not cite any reason. Commissioner Steve MInes even confided in me that he was against the votes of commissioners Melillo and Simoncini:

"I don't get it? You ARE a mensch!

Does this have to do with last nights unfortunate news? I did everything I could.

Literally on my knees to no avail.

So even though Chief Rich Barrett was guaranteed that any issues he had outside of the fire department were now closed and behind him (yes there is an audio tape of this as well, the commissioners assured him of this), Chief Barrett was denied the position of 2nd Asst. Chief by sheer bias, nepotism and cronyism. So they ran George Tockstein in an illegal 'special election'. Not all members were invited, some of the more 'malleable' members were instructed that they were not allowed to vote for Chief Barrett. Chief Barrett eventually filed an Article 78 with Westchester County Court to reverse the illegal 'special election'.

My letter to Members of GBFD 1/20/11

I would like to alert the members of the Goldens Bridge Fire Department of some issues pertinent to the proposed members of the Nominating committee named during the Goldens Bridge Fire Department’s January 2011 monthly meeting.

Albert Melillo suggested erroneously that his brother Robert Melillo should serve as committee chairman for the nominating committee as he cited Robert Melillo as the outgoing chief. Documents on this website prove beyond a reasonable doubt that Robert Melillo has served as the chairman of the nominating committee in 2009 and 2010 as the outgoing chief of the Goldens Bridge Fire Department. Walter Hughes is the current outgoing chief of the Goldens Bridge Fire Department and should be the chairman of the nominating committee. This is an attempt to pull another fast one on the department and to neutralize Walter Hughes authority as Chief.

This attempt to put Robert Melillo in the position of chairman of the nominating committee is the latest in a long string of actions steeped in nepotism and cronyism trying to be forced upon the department. Beyond the obvious reason of Robert Melillo ensuring his brother Albert Melillo is nominated as chief of the Goldens Bridge Fire Department, these are additional reasons why the nominating committee should be headed by outgoing chief Walter Hughes and the entire committee reselected:

Robert Melillo is a sitting commissioner of the Goldens Bridge Fire District. The Goldens Bridge Fire District is currently defending itself against a pending Article 78 and anyone involved in this matter is clearly showing a conflict of interest by nominating Chiefs of the Department when they are engaged in a legal dispute surrounding their decisions on approving potential Chiefs.

Robert Melillo and Jospeh Simoncini both refused to approve Richard Barrett for 2nd Assistant Chief of the Goldens Bridge Fire Department. Albert Melillo did not properly follow the by laws of the Goldens Bridge Fire Department when ordering the special meeting he called to vote on the matter of electing a 2nd Assistant Chief (Not every member of the Goldens Bridge Fire Department was notified per the GBFD By Laws for example).

Thomas Beneventano is a sitting commissioner of the Goldens Bridge Fire District, he too should not be allowed to be on the nominating committee as he too is himself defending the actions of the Goldens Bridge Fire District in approving Chief Richard Barrett in 2010. He abstained from voting due to conflict in the approval of Chief Richard Barrett but is now allowing himself to be on the nominating committee while presiding as a sitting commissioner. Clearly one decision made on the nominating committee will factor in to how a Chief is or is not received by the board of fire commissioners.

Joseph Simoncini Sr. is the father of commissioner Joseph Simoncini and should not be appointed due to his direct relation to a sitting commissioner.

Dino Magaletto is not a resident of the Goldens Bridge Fire District and should not be able to decide the leaders for the department. He is clearly appointed as a crony of the Melillo brothers and benefits from their decisions. I personally cannot recall seeing Mr. Magaletto in his turnout gear or on a fire scene. He seems to be appointed for being a close associate.

John Winter Jr. is the most removed proposed member of the nominating committee from the nepotism and cronyism in this particular set of individuals. It should be noted that his father is direct supervisor for commissioner Robert Melillo in the Town of Mamaroneck Building Department.

The Chiefs that are going to be proposed as Chiefs by this proposed nominating committee, Albert Melillo and George Tockstein do not live in the Goldens Bridge Fire District. Although this is not a pre-requisite, the service to the Goldens Bridge community will suffer especially as George Tockstein lives 11.5 miles from the Goldens Bridge Fire House. Even doing 60MPH in 45MPH and 35MPH speed zones will limit his ability to be on scene by a minimum of 12 minutes. Albert Melillo offered to me after the November 2010 GBFD monthly meeting that he was willing not to run for Chief if I would return to the department. He would not have offered this to me if it were not in the best interest of the department in the long run.

So it is up to the membership to decide if they wish to let things progress in it’s current spiraling direction resulting from the leadership that is currently seizing control. The number of disenfranchised members continues to grow. Many departments are waiting to see which direction the Goldens Bridge Fire Department heads.

Letter from Boy Scout Leaders 11/24/10

The negative environment at GBFD is not isolated to me. Here is a letter from the Boy Scout leaders pleading for assistance since the members of GBFD continue to treat the Boy Scouts as a burden instead of a partner in the community:

Thank you Brian … I appreciate your support … I would really like to address this issue and could use some advise on an approach …

I/we have been really trying to be as good, appreciative and supportive of the department as we can … what else can we do? …

the previous week, a woman from the Department was using the Firehouse Conference Room and tried to get the one Fireman occupying the back room to let us use it for our Committee meeting and the individual would not leave … she shared with me her frustration on the situation and indicated she could not do much about it …

would a sit down meeting help? … are there expectations that this individual has of us that we are not fulfilling? … how can we make this situation right? … I can involve the Council to assist us if that what it takes … can I address the Fire Department Commissioner Board?

is there a service project our Troop can do to benefit the department that would help the situation? … maybe everyone working together? … this negative air is not good for either organization … I would like there to be mutual respect and understanding between the two organizations …

it has been suggested by members of the Troop Committee that we find another Chartering Organization, but I would prefer to work this situation out since the relationship started way before any of the current individuals from either organization were involved, there is a long standing history that we would like to continue …

any suggestions would be appreciated … we truly want to do what is best for the Scouting organization and be respectful and appreciative of our Chartering Organization …

Letter to my Attorney 11/8/10

I received the packet from the Golden's Bridge Fire Dept. on Wednesday. Lt. Alex Roth is bringing me up on charges to be removed from being Captain. I will fax you the documents.

I stood up at the monthly department Tuesday evening and hung the "YOU'RE NEXT BITCH" hanger on the front desk as I spoke. I said "This was put on my gear on May 7th. This was the culmination of six months of abuse I had been put through in the department." I then took them through the history of verbal abuse, insubordination, gear tampering, the trap I set on my radio and how I had calculated how long my radio was left on through testing on drill nights. I told them I would not name names but the document I had in my hand has the names of the people involved. I explained that I was working with you and the district. I explained that now I was informed at Noon that day that I was being brought up on charges by Alex Roth via a phone call from John Winter. I said "I didn't ask for any of this". At one point I also stated that this was 'pathetic'. I was extremely calm during the entire time I spoke which was roughly 5 minutes.

I handed secretary Weigert the letter I had written to bring insubordination charges up on Lt. Roth. Eric Stand stood up when I was done and his message was essentially "how could we let this happen?". No one spoke in reply.

Later in the meeting Al Melillo stood up and try to push for action on Lt. Roth's document to bring me up on charges. President Winter stated that he would act on it next month. Al stated since I had 'opened the door' on the discussion that we should act. He asked why the department had not been given a copy of your letter to George Roberts. I explained that a copy was given to Walter Hughes. I then offered to have President Winter read it in front of the department. He declined.

At one point we had an exchange to which I said "My lawyer has advised me to not come back while you are in charge". And then the room exploded "Why the fuck are you here?" - James McManus. Others saying similar. I said "not you in particular but when Walter Hughes is not here".

Domenic Melillo stood up and stated that I should "handle this like a man not a coward" and took us through some vandalism that must have occurred to him in the past prior to me joining GBFD. He stated his car was vandalized, his boots tampered with and other things. He then stated that I 'started this' and the department is now an embarrassment in the community. I was looking directly at him the entire time and suddenly he begins to yell at me "Don't look at me, don't fucking look at me" repeatedly. Unfortunately it was quite clear that the department has gone completely hostile towards me.

Al Melillo stood up and asked President Winter if he had authority to suspend members since he is ranking officer. President Winter said yes.

After the meeting ends, Al walks over to me and tells me to come to the office with him. I ask first for Ned Canora to come with me as a witness, but am told by Al no. I ask if he is going to suspend me. He directs me to come with him.

We go into the chief's office. Al is clearly nervous as am I. I state that my legs are shaking to him. He tells me to sit down. He asks what is it going to take to get me to come back. We talk for 15 minutes or so. I state that he has influence over Lt. Roth, His Brother Commissioner Robert Melillo, His father Domenic Melillo. He tries to state he does not. I tell him he knows he does. He says he can "squash" Lt. Roth's request to remove me as Captain. I state 'of course I would want that'. I tell him "you know who is doing this to me". He does not disagree, he just does not say anything.

He then offers to me that he will not run for Chief again if that is what it will take to get me back. He is emotional at this point. We had both stated earlier in the conversation that we are both on the verge of tears over this idiocy. He states he wants to remain a firefighter and a driver but will not run for Chief if that will bring me back. I told him that the wounds I have are very deep and I have to think about it. It was a very cordial discussion but both of us were completely run down from the entire experience. As I stood up to shake his hand as I walked out he said "I guess I will see you in court". I had told him that I was understanding that he was being sincere with me and I appreciated it.

Upon reflection this all occurred 10 minutes after he was pushing to have my charges against me read out in front of the department. So I don't know what to believe to be honest.

I stopped outside to briefly chat with Lou Velasquez, John Winter Jr. and Robert Hunt on the back steps. Right inside the door, you could see Alex Roth and James McManus peeking through the windows cracking jokes to the members still inside about me. Assumedly to continue to win favor by making a mockery of me.

John Winter then approached me in the parking lot and stated he had taken the copy of my letter containing the charges against Lt. Roth. He asked me to remove the reference to Chief Hughes' daughters from the letter. I stated that this statement demonstrates the lack of respect that Lt. Roth shows for others beside myself. He agreed. He stated I must submit the letter in triplicate to Secretary Weigert to be read off at the next monthly meeting.


I spoke to Walter Hughes this morning to ask for his preference on the inclusion of the statement that President Winter asked me to remover. Walter said he would review the letter and let me know.


I would like to submit to you now what I feel should be our proposition on how to remedy the issues at GBFD:

We should request:

- Robert Melillo to resign as Commissioner and Engineer of GBFD for his actions, bias and disregard for members of the department and to sign a document that he cannot pursue a Chief's position or Executive postion in GBFD.
- Joseph Simoncini to resign as Commissioner for the financial gain on the T-Shirt proceeds through the forced purchase that used GBFD Department money allocated for a wetdown celebration which had to be canceled due to this transaction and to sign a document that he cannot pursue a Chief's position or Executive postion in GBFD
- Albert Melillo to sign a document that he cannot pursue a Chief's position or Executive position in GBFD. He may remain as 1st Asst. Chief until the end of term.
- Alex Roth to be suspended from GBFD for a minimum of 1 year from date of suspension for consistent, documented insubordination.
- Repeal of the charges brought against me by Lt. Roth to be read at the December GBFD meeting
